Class Action Cases

A class action (also known as a "representative proceeding") is a legal procedure that enables the claims of a number of persons against the same defendant or defendants to be determined in one proceeding. A class action allows one claimant (called the "Lead Plaintiff") to bring an action in court on behalf of a group of people (the minimum number who can file a class action is 7 people). The claim or claims must arise out of, the same, similar or related circumstances to be determined in one proceeding. Once the class action is filed then all class members are bound by the outcome of the case unless they opt out of the class action before a date fixed by the court.
